CHOICE OF LAW AND JURISDICTION
This Agreement shall, for all domestic and international purposes, be governed, interpreted, construed and enforced solely and exclusively in accordance with the laws of the State of Nevada, U.S.A., without regard to conflicts of law provisions. You expressly agree that the exclusive jurisdiction for any claim or action arising out of or relating to these Terms of Use or your use of the Site shall be filed only in the state or federal courts located in the State of Nevada and specifically, Clark County Nevada, and you further agree and submit to the exercise of personal jurisdiction of such courts for the purpose of litigating any such claim or action.
INTEGRATION AND SEVERABILITY
This Terms of Use constitutes the entire agreement between Discovery Productions and you with respect to the Site and supersedes all prior or contemporaneous communications and proposals between us with respect to the Site. If any provision of this Terms of Use agreement is determined to be invalid or unenforceable, all other provisions shall remain in full force and effect.
UNAUTHORIZED USE AND TERMINATION
You agree to use the Site only for authorized and legal activities. Discovery Productions reserves the right, in its sole discretion, to terminate your access to all or part of the Site, with or without notice and for any reason whatsoever.
RELEASE OF ORDERS AND DOWNLOADS
We reserve the right to not send/ship products to customers ordering from “free” email accounts, such as google.com, hotmail.com, gmail.com, etc. Upon ordering, you will be asked to provide a non-free email account for us to assign to your orders, to ensure delivery. We have adopted this policy to help combat internet fraud, and we thank all customers for their cooperation. Downloadable files will usually be released within 24 hrs of purchase if received during normal business hours (8 AM ET -> 6 PM PT); orders received after business hours, or on weekends or holidays will be usually be released on the next business day. All orders go through a series of fraud checking measures, and we thank you for your understanding.
FORUM, MESSAGE, BLOG, IMAGE COMMENT, and COMMUNITY POSTING RULES
- Content that is considered racist, obscene, x-rated, vulgar, personal attacks, slander or objectionable is not allowed. All such posts will be deleted without notice and the member who posted it may be banned at our discretion. This includes usernames, avatars & signatures also.
- Do not violate a persons privacy by publishing their personal information without their prior permission.
- Please be polite. Personal attacks (Flaming, Name Calling) on others will not be tolerated. You are welcome to challenge others points of view and opinions, offer critical feedback and input, offer factual rebuttals, but do so respectfully and thoughtfully.
- Create threads in the proper forum. Threads created in the wrong forum are subject to deletion. Threads posted in multiple forums (Cross Posting) are subject to deletion.
- Do not post SPAM. If you post spam, you risk your account being permanently banned and your message(s) will be deleted. No advertising is allowed without prior approval by us. Also, do not send spam via private messages.
- Do not promote or advertise your affiliated websites, domains, companies, or services. This includes starting a thread, replying to a post, or putting it in your signature. If there is any content on your webpage that solicits fees, it may be deleted. If a member is seeking assistance or looking for a certain type of product, you are allowed to link to websites, products, and/or other information that is directly helpful and relevant.
- Users may disagree with the decisions or actions of the moderators and/or administrators, however, disagreements, criticism and the like are not to be aired publicly. Please feel free to contact us, or the person directly, rather than posting publicly.
- Any abuse towards our staff and/or management will result in immediate suspension of your posting privileges and possibly your account.
- Please keep your signature to a minimum of 3 lines, you may link to your own website, as long as it’s not considered spam. Do not put any kind of advertisements in signatures. Signature text should comply with our regular posting rules. The image may not be linked. If your signature is in violation of any of these new rules, we may remove it without prior notice. Please keep in mind that signatures should not be overly-distracting, animated, offensive, malicious, racist, or pornographic in nature.
